Bankruptcy Unfortunately, many times our clients are facing possible bankruptcy at the same time they are dealing with a divorce or other family related issue. We have a great deal of experience in this area and can represent you in both Chapter 13 and Chapter 7 bankruptcy filings. Whether you are seeking to discharge as much debt as possible with a Chapter 7 filing, or seeking more time to pay off your debts with a Chapter 13 plan, we will see that your filing is handled properly. We make certain that you receive all the protection that is available to you under the federal bankruptcy laws and that you are treated fairly by the courts and your creditors. Probate We handle all aspects of probate, including advising personal representatives in connection with the initiation, administration, and supervision of estates, and other related proceedings. Probate is a legal process whereby (1) a judge determines whether or not a decedent's will is valid; (2) a personal representative is appointed to (a) collect the decedent's assets in his or her probate estate, (b) pay the decedent's legal debts, and (c) distribute the remaining assets in the decedent's probate estate to the individuals or entities entitled to the assets; and (3) the court approves the transfer of the decedent's assets to the individuals and entities designated in the will or the laws of intestacy.
